Lane splitting remains illegal in Germany

Lane_splittingThe German organization of public prosecutors has opposed the ban of lane splitting with/for motorcycles in Germany. They see such rule collide with the prohibition of right-side overtaking of another vehicle while driving on roads. Performing lane splitting when driving for instance in a traffic jam or when sneaking between cars to the front of the traffic light will be punished by a 100 Euro fine.

The only loophole in German law is the area between the most left lane of a motorway and guardrail / median, as here overtaking is allowed when the distance between your motorcycle and the car is 1 meter or more (which is often not the case).

    This is really too bad. Lane splitting has been shown by the study that UC Berkeley did to be a safer option for traffic jams.
    It also just sucks to have to sit in vehicle traffic when you don’t have air conditioning, a radio, or other creature comforts. I want to get where I’m going smartly and safely.

    • You are completely right!
      I have talked today regarding this topic with German colleagues, and some are performing lane splitting although it is not allowed and not all police officers will ticket you.
      In the Netherlands, where I live, you are allowed to do lane splitting when following some basic rules which are there to safeguard you as a motorcycle driver. I use a little more limiting rule that only when traffic is standing still or driving extremely slowely, I will do lane splitting.

        Yah. I am about to start doing it through downtown traffic at red lights.
        I’m in Kaiserslautern Germany and the polizei don’t seem to be very prevalent here. I also first rode Europe in 2004 in Italy, and there… You split two-way traffic.
        Anyhow, we will see how much I get away with!!

      • Keeping my fingers crossed that die Polizei remains merciful to you.
        With living in Kaiserslautern you are at a nice place for motordriving, as Eiffel and Ardennes are close by and going to the Alps takes you at least 3 hours less than for me. I have been this month twice to the Eiffel to have a 175 km ride around the Rursee, which was fun. Nice is also that you have several biker restaurants to have some lunch or a drink.

    Guys what about a case when you splitting through standing cars, will it be considered as overtaking?
